Three Noodles Terms of Service

Who Can Use Three Noodles

You must be at least 18 years old to use Three Noodles, or have the consent of a parent or guardian as described in our Privacy Policy. If you use Three Noodles Dashboard on behalf of a company, you confirm that you can bind that company to these terms. You are responsible for keeping your account credentials secure and for all activity under your account.

What Customers Pay For

Customers pay for access to Three Noodles Dashboard and for the games and widgets they publish. Fees are billed in advance and are non-refundable. You may cancel at any time, and your access continues through the end of the period you paid for.

Your Content

Customers keep ownership of the content they bring to Three Noodles, including brand assets, articles, images and other intellectual property used to create games. You give us a limited right to host, process and display that content only to operate Three Noodles for you, including generating games with AI and showing them in Three Noodles Widgets. You are responsible for having the rights to the content you provide.

Games and AI-Generated Content

Three Noodles uses AI to help create games, questions and related content. AI output can be inaccurate. Customers are responsible for reviewing games before publishing them and for the content they publish on their websites.

Players

People who play games through Three Noodles Widgets on a Customer Website may use them for personal, non-commercial play. Don't cheat, use bots or scripts, tamper with leaderboards, or choose usernames that are offensive, impersonate others or infringe someone's rights. We or the Customer may remove usernames and scores that break these rules.

Text Messaging

Customers may receive account text messages, and players who opt in may receive game text messages. Our Text Messaging Terms explain these messages and how to stop them.

Acceptable Use

Use Three Noodles only for lawful purposes. You may not use it to:

• break the law or help others break it;
• create games or content that is hateful, harassing, sexually explicit, violent or exploitative, or that targets children;
• deceive people, spread misinformation or impersonate others;
• infringe anyone's intellectual property or privacy rights;
• probe, overload or attack our systems, or access them other than through the interfaces we provide;
• resell or sublicense Three Noodles without our written permission.

Safety and Enforcement

We may monitor Three Noodles for abuse, refuse to generate or publish content that breaks these terms, and suspend or terminate accounts that violate them.

Availability

We work to keep Three Noodles reliable, but we do not guarantee uninterrupted availability. We may change or discontinue features, and we will give Customers reasonable notice of material changes.

Disclaimers and Limitation of Liability

Three Noodles is provided "as is" to the extent the law allows. Our total liability for any claim relating to Three Noodles is limited to the amounts you paid us in the 12 months before the claim. We are not liable for indirect, incidental or consequential damages.

Governing Law

These terms are governed by the laws of the State of New York. Disputes will be resolved in the state or federal courts located in New York County, New York.

Changes to These Terms

We may update these terms. We will give advance notice of material changes, and continued use of Three Noodles after they take effect means you accept them.
